New accelerated INPI patent procedure for anti-COVID inventions

By decision of April 21, 2021 of the Director of the INPI, inventions related to anti-COVID treatments or devices may be subject to an accelerated patent grant procedure.

The applicant must file a request to this effect within 10 months from the filing of the patent application or utility certificate. This request is free.

The INPI then undertakes to issue the patent within 24 months from its filing date.

It should be noted that the subject of the patent must, to benefit from this accelerated procedure, have given rise to a request for a clinical trial, a request for evaluation of a treatment for COVID, a request for marketing authorization market or a request for conformity assessment from a notified body with a view to CE marking.
